1. Acceptance of Terms
By accessing or using Ara ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Ara is an AI-powered messaging platform that provides real-time communication, automatic translation, message summarization, and intelligent message assistance. The Service includes mobile applications and related backend services.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. AI-Powered Features
The Service includes AI-powered features such as chat assistance, translation, summarization, and suggested or automatic replies. You acknowledge and agree that:
- AI-generated content is provided for reference purposes only and may contain errors or inaccuracies
- You are solely responsible for reviewing and verifying any AI-generated content before relying on it
- We do not guarantee the accuracy, completeness, or suitability of AI-generated responses
- AI features that perform actions on your behalf (such as email operations or automatic replies) are initiated based on your configuration and instructions, and you accept responsibility for their outcomes
5. Automatic Reply Features (AutoChat)
The Service offers AI-powered automatic reply features ("AutoChat") that can generate and send messages on your behalf based on your configured settings. AutoChat operates in multiple modes, including Suggest (manual approval required) and Semi-Auto (automatic for safe messages, approval for others). By enabling any AutoChat mode, you expressly acknowledge and agree that:
- Messages generated by AI and sent through AutoChat are treated as your own messages and are sent under your identity — recipients are not notified that the message was AI-generated
- You bear full responsibility for the content, consequences, and legal implications of all messages sent through AutoChat on your behalf, regardless of mode
- In Semi-Auto mode, messages may be sent automatically without your individual review or approval
- AI-generated messages may not perfectly reflect your intended meaning, tone, or stance
- We are not liable for any consequences arising from automatically generated or sent messages, including but not limited to misunderstandings, commitments, or relationship impacts
- You can disable AutoChat or change modes at any time through the conversation settings
- You should use Suggest mode for sensitive or important conversations where accuracy is critical
6. Email Integration
If you choose to connect your email account, you acknowledge that:
- Email actions (including search, read, and delete) are performed based on your instructions through the AI assistant
- Email deletion may be irreversible depending on your email provider's policies
- We are not responsible for any loss of emails or data resulting from actions taken through the Service
- You should verify important email actions before confirming them
7. Prohibited Input
You must not input the following types of sensitive information into AI conversations or any text field within the Service:
- Passwords or authentication credentials
- Credit card or payment card numbers
- Social security numbers or government-issued ID numbers
- Bank account or financial account details
- Medical records or health information
We are not responsible for any consequences arising from the voluntary disclosure of such information through the Service.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to transmit harmful content
- Attempt to interfere with or disrupt the Service
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Use the Service to send spam or unsolicited messages
9. Intellectual Property
The Service and its original content, features, and functionality are owned by Ara and are protected by international copyright, trademark, and other intellectual property laws.
10. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
11. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- In no event shall Ara, its operators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars (US$100), whichever is greater
- We are not liable for any damages arising from AI-generated content, automatic replies, email operations, or any actions performed by AI features on your behalf
13. Indemnification
You agree to indemnify and hold harmless Ara and its operators from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Service or by other means. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
